Definitions

“Marketing Agent “- the person or company who is marketing on behalf of the caravan Owner

“Owner” – the registered Owner of the property – who has responsibility of any agreement between themselves and Hirer

“Hirer” – the person named as Hirer is the – the person who has a responsibility to the Owner for the agreement

Any agreement, offer or implied contract marketed by the Marketing Agent is on behalf of the Owner and Hirer, any implied contract/ agreement is directly between Owner and Hirer.

The Marketing Agent accepts no responsibility for any implied contract/agreement

Should Hirer or Owner refuse to accept these terms neither party can use the services of the Marketing Agent.

We may use cookies on our web pages, if you do not agree to the use of cookies do not use the web pages.

Hirer & Owner are deemed to be aware of the Marketing Agents’ terms and conditions and are deemed to accept these terms and conditions and those of the caravan site .

Hire of a property is for Holiday purposes only, accommodation will normally be available from 14:00 (2pm) on stated arrival date and the property must be vacated by 10:00 (10am) on stated departure date.

Written permission to occupy the caravan outside these stated times must be agreed between Owner and Hirer in writing.

The Hirer is deemed to have cancelled the booking if full cleared payment of deposits, balance, security bond is not paid on the dates stated in any offer, implied agreement or confirmation documents.

The Caravans manufacturers maximum occupancy must not be exceeded

The Owners stated maximum occupancy must not be exceeded

If the Hirer allows the occupancy of the caravan to be exceeded their party will be expelled immediately without refund or compensation,

Admission will be refused if the Hirer indicates they intend to exceed the maximum property/caravan occupancy without refund or compensation

The Marketing Agent, Owner, any Agent, Site Representative/Staff or any nominated contractor reserves the right to enter the property/caravan at any time deemed necessary by the Owner.

The Owner, Marketing Agent accepts no responsibility for events outside our control, examples include extreme weather, power cut, water shortage or other act of god.

The Owner and Marketing Agent will not accept any liability for loss or damage incurred by the Hirer; any third party; visitors or contractors during any offered or confirmed offer / agreement.

HOLIDAY INSURANCE IS HIGHLY RECOMMENDED

In the event the caravan is not available for the offered/agreed/confirmed period the Owner will notify you as soon as possible, the Owner’s liability is limited to deposits received. Any fees paid to the Marketing Agent will not be refunded to the Owner or Hirer.

The Marketing Agent is not a regulated Travel Agent

Deposits are paid to the Owner.

Deposit may on occasion be handled/administered on behalf of the Owner /Hirer by the Marketing Agent.

If the property and its contents is not deemed to be acceptable on arrival the Hirer must contact the Owner immediately and in all cases within 24 hours of arrival date

If the property and is contents is not deemed to be acceptable on departure the Owner must contact the Hirer immediately and in all cases within 24 hours of the departure date

We advise Owner and Hirer to capture digital images of any damage to the property or contents and forward these within 24 hours of arrival / departure to the Marketing Agent by email.

Cleaning charges will be levied by the Owner in the event the property/caravan and all equipment/utensils and furnishing are not left in a satisfactory condition on the departure date. This charge is a minimum of £50 (Fifty Pounds) .

Any breakages during the hire period are the responsibility of the Hirer and the cost of breakages/loss will be recovered from the Hirer within 7 days of departure date.

All contents / equipment / Utensils/ Furnishings must be clean and tidy on arrival and departure

If the Owner provides any bedding/towels they must be fully laundered by the hirer before departure.

A minimum charge of £50.00 (fifty pounds) will be charged by the Owner to the Hirer if bedding/sheets/towels are found to be left soiled or damaged on departure.

Bedding/Sheets/Towels are not provided as standard.

The Hirer is responsible for the cost of any cleaning or breakages during their stay.

It is the Owner responsibility to issue Equipment operating instructions for safe use of equipment .

For the avoidance of doubt the safe use of all equipment if the responsibility of the Hirer following the operating instruction provided by the owner.

In the event the Hirer does not deem equipment is safe to use the must notify the Owner immediately.

Hirer – do not use any equipment you may deem to be unsafe – always contact the owner directly.

Any shortage from the itinerary must be notified to the Owner upon arrival, please also advise the Marketing Agent by email of any discrepancy in relation to the marketed offer / confirmation.

Owners must display an Itinerary of Equipment and Equipment Operating Instruction in the caravan/property.

Electricity / Gas supply must not be modified by Owner or Hirer, it must be to a site safe standard, the Owner is responsible for an annual electrical and gas check on the property/caravan and appliances in alignment with caravan site rules/licence / policy and insurance.

A security bond is normally required by the Owner as stated on any offer or confirmation agreement.

Upon Satisfactory Inspection of the property the Owner will normally arrange to refund the security bond within 14 days, this completes any implied agreement between Owner and Hirer.

The property/caravan is hired on the basis that there is no right to remain in the property by the Hirer, or any 3rd party they may permit to enter the property/caravan

Regrettably, NO PETS ALLOWED

No Smoking allowed in the property/caravan or within 1 metre of the property or any other property/caravan/building on site.

Key handling is the responsibility of the Owner

Hirers please contact the Owner whose details are on the confirmation document.

Sites may on occasion issue keys on behalf of the Owner – please ensure your arrival time is confirmed with the Owner and arrival should be no earlier than 2pm or later than 4pm on the arrival date.

In the event of keys being handled by site they must be returned to the site office on departure no later than 10am on the stated departure date

Deposits paid on a booking are strictly non refundable

Site Rules and Regulation are available for inspection on site

The Marketing Agent facilitates a connection between Owner and Hirer only

It is the Owners responsibility to ensure the agreement is to the satisfaction of the site

It is the Owners responsibility to ensure the caravan meets the requirement of hire implied by the site

Breach of the following will lead to a booking /contract being terminated immediately without compensation to the Hirer:

The Site / Owner will not accept unreasonable levels of noise or disturbance to other guests,

Hirer must not be deemed a nuisance to another Owner / Hirer including but not limited to noise from music, instruments, vehicles. 

Vehicles / Tents cannot be used as alternative sleeping arrangements

Tents and Motorhomes are not permitted on the site.

Car passes must be displayed in Hirers vehicles as required by the site

Speed limits must be adhered too as indicated on site

Maximum 2 vehicles per caravan/property

Parking only permitted in spaces provided

No business-related vehicles, boats or jet skis to be parked between the caravans

Vehicle height restrictions apply – check with site / Owner (normally 2 meters)

No driving between or behind caravans 

No Learner drivers on site 1

No battery or petrol motor scooters (Excluding mobility scooters) 

Refuse must be placed in skips / bins provided, a service charge applies for cleaning up refuse from inside or around the caravan.

Please do not send children to dispose of refuse.

Owners and Hirers must be aware of the nearest fire point, emergency phone, emergency procedures for fire, flood, site evacuation.

Hirers must book into site

Visitors must book into site

Contractors must book into site

Owners / Hirers must be aware of how to turn on / off all utilities services

Operating instructions for all permitted appliances must be supplied by the Owner and adhered to by the hirer

Hirers should only use appliances with written instructions clearly displayed in the caravan.

Do not flush foreign objects into the toilet e.g wipes / towels / nappies

No Chip Pans allowed

Children must always be supervised

Ball games only permitted in recreation areas, all recreation areas can be used until 9pm

No pellet guns / bb gun allowed

No washing lines permitted

Do not feed the seagulls

There is a zero-tolerance policy to violence, or threats of violence – if breached offenders will be removed and banned for life from caravan / site and all properties marketed by the Marketing Agent.

 If terms and conditions are breached it will result in admission being refused or immediate expulsion without compensation. 

It is the Hirers responsibility to ensure windows and doors are secure at night

It is the Hirers responsibility to ensure windows and doors are secure when they are not occupying the caravan/property

All personal belongings to be kept in a safe place out of view

Please report suspicious activity to Reception

if you are certain a crime is in progress call 999 immediately

Anyone not registered as an Owner, Hirer or visitor will be asked to leave the site immediately

COVID – 19 – Coronavirus – Additional Terms & Conditions

The owner must confirm that this caravan has:

1. Relevant Safety Action Notices clearly displayed. i.e. Fire, Flood
2. A current Electrical and Appliance Certificate and Landlord’s Gas Safe Certificate
3. At least one prominently positioned Fire Blanket
4. At least one working and tested Smoke Alarm and CO detector ✓
At least one working, tested, and appropriate Fire Extinguisher, with instructions for use
6. Detailed instructions for ALL appliances (Clearly displayed in caravan )
7. Copy of Site Rules and Regulations clearly displayed in Caravan
8. Clear instructions for turning ON and OFF Gas, Electricity supply, and Water
9. Caravan cleanliness and general condition is of an acceptable standard
10.CONDUCTED A COVID 19 RISK ASSESMENT. CARAVAN CLEANLINESS & GENERAL CONDITITON IS OF AN ACCEPTABLE STANDARD AND IN LINE WITH COVID19 GUIDELINES ✓

Controls:

• Follow government guidance on hand washing

• Ensure you wash hands thoroughly for at least 20 seconds using soap and water upon entering the caravan,

whenever you eat or handle food and whenever you cough or sneeze

Action required

• It is the responsibility of Hirer |Group Members | Visitors | Contractors to ensure hands are washed as per

current UK & Welsh government guidance on hand washing

• It is the responsibility of the hirer to monitor and supervise hand washing

• It is the responsibility of the owner to ensure notice/signage to remind Hirer |Group Members | Visitors |

Potential Hazard: -Getting or spreading coronavirus in common use high traffic areas such as kitchen, toilets and

other communal areas

Who Might be Harmed:

Owner | Hirer |Group Members | Visitors | Contractors

Controls:

• Follow government guidance on hand washing

• Ensure you wash hands thoroughly for 20 seconds using soap and water upon entering the caravan,

whenever you eat or handles food and whenever you cough or sneeze

• Contact surface to be regularly sanitised

• Contact surface to be fully sanitised on arrival and prior to departure

• Ensure Social Distancing

Action required

• It is the responsibility of Hirer |Group Members | Visitors | Contractors to ensure hands are washed as per

UK & Welsh government guidance on hand washing, and to ensure social distancing guidance is followed as

per the UK and Welsh government legislation.

• It is the responsibility of Hirer |Group Members | contractors to ensure contact surfaces are regularly

sanitised

• It is the responsibility of Hirer | Contractor to ensure the caravan is fully sanitised on arrival and departure

including bed and bedding. PPE (Personal Protective Equipment) including face mask/gloves/disposable

apron are advised to be until when entering the accommodation and until the accommodation is inspected as sanitised to the hirers satisfaction.

• No unauthorised visitors are allowed onto the park

• No social gatherings with anyone who does not live in your normal family household is allowed in the

caravan

• It is the responsibility of Hirer |Group Members | to ensure no unauthorised visitors enter the park

• It is the responsibility of Hirer |Group Members | to ensure UK Government and Welsh Government

guidelines are followed on social distancing

• It is the responsibility of Hirer to ensure that no one who does not live in the normal family household is

allowed to enter the accommodation at any time during the duration f their stay.

Potential Hazard:

Getting or spreading coronavirus by not cleaning surfaces and equipment

Who Might be Harmed:

Owner | Hirer |Group Members | Visitors | Contractors

Controls:

• All surfaces and equipment to be sanitised before use.

• Use own bedding, mattress and pillow protection

Action required

• It is the responsibility of Hirer |Group Members | Visitors | Contractors to ensure hands and all surfaces and

all equipment are sanitised before use.

• It is the responsibility of the hirer to monitor and supervise that hands, surfaces and equipment are sanitised

before use

• It is the responsibility of the hirer to ensure own bedding, mattress and pillow protectors are used.

Potential Hazard:

Contracting the virus by not social distancing

Who Might be Harmed:

Owner | Hirer |Group Members | Visitors | Contractors

Controls:

• Follow government guidance on social distancing at all times

• No Social gatherings inside or outside the accommodation

Action required

• It is the responsibility of Hirer |Group Members | Visitors | Contractors to ensure Social Distancing as per

UK & Welsh government guidance

• It is the responsibility of the hirer to supervise social distancing rules are followed.

Keeping Everyone Safe Information & Rules

Abbreviation – ELP-Edwards Leisure Park

Contact the Owner – Details issued on Track & Trace Form

• If a contractor or member of ELP Team needs to enter the accommodation you will be asked to remain

outside the accommodation whilst they are inside the accommodation.

• No unauthorised visitors to ELP

• No social gatherings with friends or anywhere on ELP

• Members of the same household only allowed inside the accommodation

• Accommodation is for Holiday use only

• Children must be accompanied at all times by a parent or guardian at all time to ensure Social Distancing

• Children must not be unsupervised

• The play area & laundry remain closed until allowed by Welsh Government

• Antisocial, threatening or violent behaviour is not tolerated and will lead to immediate expulsion/departure

for all members of the hirers party.

• DO NOT VISIT ELP IF YOU, OR ANY OF YOUR HOUSEHOLD HAVE TESTED POSITIVE OR HAD SYMPTOMS OF

COVID 19 IN THE 14 DAYS BEFORE YOUR ARRIVAL DATE OR IF YOU HAVE BEEN IN CLOSE PROXIMITY OF

ANYONE SHOWING SIGNS OF SYMPTONS OF CORONAVIRUS/COVID 19. DO NOT VISIT ELP IF YOU HAVE

BEEN INSTRUCTED TO SHIELD OR SELF ISOLATE. DO NOT VISIT ELP IS YOU ARE A VULNERABLE PERSON OR

FEEL UNWELL. DO NOT VISIT ELP IF YOU ARE FROM AN AREA / REGION UNDER LOCKDOWN.

• Hirer is responsible for Health & Safety of their party

o failure to receive the keys will mean loss of security deposit.

• Security deposits will not be refunded until keys are returned to the owner

• Call Out charges for maintenance issues are a minimum £66.00 (Sixty Six Pounds) and issues to be reported

to direct.caravans@outlook.com – in the event the hirer or their party contact site maintenance personal without the owners authorisation all charges are payable by the hirer.
